Boat Hire Terms and Conditions

Conditions of hire:

  1. Buoyancy aids are compulsory for; all under 18 year olds, any weak or non-swimmers, and all paddle sports.
  2. The minimum age to hire a boat is 18 years old; they need to agree to these terms, and assume responsibility for the craft and its occupants.
  3. There is a minimum age of 1 years old for our pedalos, and 12 years old for our kayaks. Any under 18 year olds on kayaks must have an over 18 year old on the water with them.
  4. All craft are hired at the hirer’s risk; the hirer assumes responsibility for damage to property howsoever caused.
  5. The hirer is responsible for the safe and reasonable use of the craft.
  6. The hirer is responsible for ensuring craft are not left unattended throughout the duration of their hire.
  7. The hirer must ensure that their hired craft is returned at the end of hire; late returns will be charged at the discretion of our staff.
  8. To ensure your safety, the security of wildlife, and the safety of other water users, hired craft must stay within the boat hire boundary, which is marked by buoys.
  9. No one should disembark their craft anywhere except the designated boat jetty.
  10. No one should attempt to embark or disembark without staff assistance.
  11. We reserve the right to refuse or terminate hire at any time.
  12. No one will be allowed to embark a boat if they are under the influence of alcohol or drugs, or exhibit unreasonable behaviour.
  13. Threatening behaviour, verbal or physical, will not be tolerated. Your hire will be refused or terminated, and you may be asked to leave the site.
  14. Any behavior or actions that disturb or threaten the wildlife or environment will not be tolerated. This includes; approaching wildlife, touching wildlife, fishing from craft, or damaging plantlife. Your hire will be refused or terminated, and you may be asked to leave the site.
  15. Hirers must follow instructions from our staff, and read any materials if asked to; if you need further assistance or information please do ask and we’ll support you.
  16. Our boats have a maximum occupancy and weight capacity; for your safety our staff reserve the right to refuse hire if the occupancy exceeds safe limits. For our kayaks, this maximum weight is 120kg.
  17. Dogs and other pets are not allowed on any of our craft.
  18. We ask that you don’t consume any food whilst on your craft. Resealable bottled drinks are allowed but no cans or glass. Please place any rubbish into the bins provided.

Refunds; cancellations made by us:

  1. We reserve the right to cancel hire operations if inclement weather is forecasted. We will notify all bookings by 8pm the day before your scheduled hire; you will receive a full refund.
  2. We reserve the right to cancel hire operations for any reason, including but not limited to; unforeseen circumstances, emergencies, or force majeure. This will trigger full refunds for all bookings affected.
  3. In the event of your booking being cancelled by us because of your behaviour, actions, or non-attendance, refunds will not be offered.

Refunds; cancellations made by the hirer:

  1. Cancellations made with at least 12 hours notice will receive full refunds.
  2. Any cancellations made with less than 12 hours notice will not be refunded.

Transfers and amendments:

  1. You can transfer your booking to a different time / date up to 4 hours before your scheduled hire, this won’t incur a fee.

Data protection:

  1. We deal with all information we hold about you in line with our privacy policy which can be found on our website.
  2. If you want to know what information we hold about you, or you want us to correct any information we hold about you, the appropriate procedures are set out in privacy policy.

Liability:

  1. We will not be liable to you for any loss or damage you may suffer where this is attributable to; your own fault, a third party unconnected with our provision of services, or events which could not reasonably be forestalled even with reasonable care.
  2. If you know or are concerned that you have a medical condition which might interfere with your safe participation in water sports, you should get advice from a relevant medical professional.
  3. Personal belongings are the responsibility of the hirer; they are left at your own risk.
  4. Nothing in these terms and conditions are intended to limit or exclude our liability for death or personal injury caused by our negligence or for fraud, fraudulent misrepresentation, or any other liability which cannot be excluded by law.
